Description

She is a classic ocean-capable and a flagship for this design from Bruce Farr.

At 57ft and with a stateroom layout, Escape Artist is luxury charter.

With an elevated view for navigation the centre cockpit serves as well as a spacious entertaining area, spreading out onto the expansive after deck. With this layout, the hull from stern to bow is available to create a well-appointed interior, where function is not compromised by a lack of space.

As a stateroom layout suggests, down aft is a king sized bedroom with private ensuite and extra seating that can double as a small bed when under way. Forward are two separate double cabins, each with its own ensuite and a shared shower that offers privacy from either side.

The galley has, a 110 litre refrigerator, 100 litre freezer, gas oven and microwave operational when the generator runs. A twin single crew cabin and facilities are on the starboard side. The saloon makes use of the full girth of the ship, with a good-sized dining table and ample seating for everyone on board. 

She has great storage with cabinets accessible for easy stowing of every item.

BELOW INFORMATION AND DETAILS APPLY TO BAREBOAT SELF DRIVE HIRE

Bond
A bond payment of $5000NZD is required prior to the commencement of the hire. The hirer is responsible for any losses or damage to the vessel and equipment, while on hire, to a maximum value of $5000NZD provided the hirer is not in breach of any of the terms and conditions incorporated in the contract.

A comprehensive pre-hire familiarization (briefing) is given to the designated captain on vessel prior to departure, usually takes 45-60 minutes and if possible to be conducted prior to loading the vessel. However, this is not always possible. A manual of the briefing notes are kept on board. Terms and Conditions Hire Agreement must be completed upon payment of the 50% deposit. Resume of Experience must be completed upon enquiry – Bareboat charter to suitably experienced persons to satisfy minimum insurance requirements. No formal qualifications required but recommended. Vessel management will await the arrival of your return at the marina – please advise prior to booking if you require assistance berthing the vessel

At Completion of the Charter
In accordance with the Terms and Conditions Agreement you will be signing, you are asked to leave the vessel in a clean and tidy condition inside and out.
If the vessel has been used for fishing, then all areas used for fishing must be scrubbed down and left clean of any bait residue including any burly around the topsides or anchor areas, the outside of the transom and in the supplied buckets, etc.
The vessel management company reserves the right to apply a cleaning charge if this has not been done to their satisfaction.


Terms and Conditions

HIRE CHARGE 
The Charterer shall pay the Charter Fee to Decked Out Yachting Limited in two equal installments:
• 50% deposit at the time of booking; and,
• the remaining 50% not less than 14 days prior to the commencement date of the charter.

The bond of $5000 can be paid by bank transfer or by credit card.

REDELIVERY
The Charterer will return the vessel to its marina at the time and date specified in this agreement where the Charterer will peacefully give up possession of the vessel to the Management Company.

Where weather conditions are such that an ordinarily experienced person in charge of the vessel would not take the vessel to sea and are likely to prevent the return of the vessel to its marina by the time and date specified in this agreement the Charterer shall immediately notify the Management Company of the delay and the expected time and date of return of the vessel.

Where the Charterer:
1. does not return the vessel to its marina by the time and date specified in this agreement; and,
2. there have been no weather conditions of the type which would have prevented the due return of the vessel by an ordinarily experienced person in charge of the vessel; and,
3. the Charterer has made no other arrangement with the Management Company

the Charterer shall pay the Owner on demand as liquidated damages a sum equal to one day’s charter fee for every day or part thereof that the vessel is overdue. That sum may be deducted from any bond or, shall be due and owing to the Owner as liquidated damages and shall be recoverable as such by the Owner in any court of competent jurisdiction in New Zealand; and, the Owner shall be entitled to treat the vessel as having been unlawfully converted by the Charterer for his own use.

BOND
The Charterer shall pay to the owner the sum of Five Thousand Dollars ($5000) as a bond. Except where the Charterer has been negligent, has operated the vessel under the influence of alcohol or drugs, or has breached Ministry of Agriculture & Fisheries fishing regulations for which the charterer’s liability shall be unlimited, this bond shall be the maximum amount of the Charterer’s liability for loss or damage to the vessel.

When the vessel is returned the Management Company shall be entitled to deduct from the bond the costs of additional cleaning if required as specified, repair or replacement of the vessel or any of its equipment or any liquidated damages payable under this agreement. Any surplus after these deductions, or, where there is no deduction the whole of the bond shall be promptly refunded to the Charterer.

DAMAGE
If the vessel is damaged or involved in any accident during the Charter Term, the Charterer will immediately advise the Management Company of the damage or accident and of the full circumstances surrounding the damage or accident. If any damage has caused, or is likely to cause, any structural damage to the vessel, the Charterer will not use the vessel until it has been inspected by the Management Company or the Owner. The Charterer shall be solely responsible for payment of any repairs executed to the said vessel or its equipment without the written authority of the Management Company or the Owner.

RUNNING COSTS
The Charterer shall bear, pay and discharge all ordinary running expenses (Diesel and LPG) and will take reasonable care in handling the said vessel and attend to the running expenses.

RESTRICTED USE
The Charterer will not sub-let, hire or part with possession of the vessel to any other person, nor allow any person other than the Charterer to have control of the vessel at any time.

RECALL OR POSSESSION
The Management Company and the Owner reserve the right to terminate the charter and retake possession of the vessel without notice:
1. immediately upon breach by the Charterer in the observance or performance on his part of this agreement or any of its terms and conditions ;
2. if the vessel is damaged;
3. if at any time prior to or during the Charter Term the Management Company or the Owner considers that weather or water conditions endanger the vessel, the Charterer, his passengers or crew.
Termination shall be without prejudice to the rights of the Management Company or the Owner in respect of any prior breach by the Charterer of this agreement or any of its terms and conditions.

LIMITATION AND LIABILITY 
The liability of the Owner is to maintain the vessel to the standard required by the Safe Ship Management System governed by the Maritime Safety Authority and he will not be responsible for personal injury or property damage arising from any defect or fault which the Safe Ship Management System does not bind him to remedy.

The Charterer acknowledges that:
1. he will keep the ship´s log book up to date;
2. he has inspected the vessel at the commencement date of the charter and had a safety briefing including the use of lifesaving equipment;
3. the vessel is in good order and in a safe and suitable condition for the purpose for which he has chartered it; and that,
4. If the vessel is unable to start or complete the charter due to mechanical failure or serious structural damage or defect not caused by the Charterer or his agents employees or invitees the liability of the Owner is limited to refunding only the bond or balance of the bond and the unused portion of the charter fee.

INDEMNITY
The Charterer indemnifies The Owner against any damage and claims for damage to property or persons caused by or arising from his use of the vessel during the Charter Term.

NAVIGATION AND OUTER LIMITS 
The vessel must be at anchor or berthed by sunset and, except where a move is necessary for the safety of the crew passengers or vessel or where express permission has been given by the Management Company shall remain at anchor or berthed during the hours of darkness.

To ensure the safety of the vessel and its contents under no circumstances is the vessel to be left unattended during the hours of darkness. The vessel must be kept in view while the Charterer and passengers are ashore during the day.

The operational limits for the vessel are defined on the survey charts supplied on the vessel as follows: Inshore limits Northland / Auckland and an area within BARRIER Inshore Limits, inside an area commencing at Hereheretaura Point, from there 070o, 18 miles to the NZ Territorial limit, from there northwards along the coast of the North Island following NZ Territorial Limit to the position of 090o 12 miles of Cape Barrier, then from Needles Point, heading N/W 300o to the NZ Territorial Limit and from there direct to Bream Head as defined by the Maritime Safety Authority regulations. This excludes the Mokohinau Islands and eastern side of Great Barrier Island. You need to apply when taking the boat to the Bay of Islands.

COMPETENCY 
The Charterer declares that:
1. he is aged twenty five or over;
2. the charter party does not exceed the number of persons licensed for the vessel;
3. he has read and fully understands the Hire Agreement, and that he has received a copy of it;
4. he is capable of control of the vessel , and has the nautical knowledge and experience required to use the vessel in a manner which is safe for him his, passengers and invitees , and the public at large.

CLEANING 
The vessel will be delivered clean and prepared for charter, the Charterer will return the vessel in the same standard; The Management Company reserves the right to charge cleaning fees to the Charterer and to deduct those fees from the bond. Please note that black soled shoes mark the deck of the vessel and this will also incur a cleaning fee.

SMOKING 
For the safety and comfort of the vessel and passengers, smoking is not permitted inside the accommodation.

 

DECLARATION 
I understand that should my previous experience not be considered adequate to skipper this vessel, the Management Company and/or the Owner reserve the right to cancel this charter or provide a professional skipper at my expense. I have read and agree to comply with the terms and conditions of hire. I also agree to ABIDE BY THE LAW that I as the master of the vessel, will not consume excessive alcohol or take drugs whilst on this charter.
